Mini Songwriter Terms of Use
These are the terms you agree to when you use Mini Songwriter. They are written to be read, not to be got past. If a sentence here is unclear, write to us and we will say it better.
1. Who we are
Mini Songwriter is operated by Vanech Inc., 1 Bloor Street East, Toronto, Ontario, Canada M4W 0A8. You can reach a person at hello@minisongwriter.com.
In these terms, "we" and "us" mean Vanech Inc., and "you" means the parent or legal guardian who holds the account.
2. What the service does
Your child tells us about their day, in their own words, by speaking or typing. We write lyrics from what they said, record an original song in a sound they choose, and save it to their My Songs — a private library that only your household can see.
One new song per child per day. The songs are made by software, so no two are the same and we cannot promise a particular one will come out the way you hoped. If a song fails to come out at all, it does not use up your child’s day.
This is an account for a grown-up. Your child has no login and no email address with us. You are responsible for who in your household uses the account.
3. The free songs
A new account gets 3 free songs, for the household, with no subscription and nothing charged. They do not expire.
We ask you to set up a card before your child tells us anything. We do not charge it to give you the free songs. We use the card check as part of our process for obtaining verifiable parental consent, and it is explained in full on the screen that asks for it.
4. Subscribing, and what it costs
When the free songs are used up, one child is C$19.99 a month in Canada or US$14.99 a month in New Zealand and the United States, and each brother or sister is C$14.99 or US$10.99 a month, up to three children. Which one applies to you follows where your family lives — you tell us once when you sign up. We will always show you the price before you agree to it.
A subscription renews every month until you cancel. Payments are handled by our payment processor; we never see or store your card number. If a payment fails, song-making pauses and every song you already have stays where it is.
If we ever change the price, we will tell you before it applies to you, and you will be able to cancel instead.
5. Cancelling, and what happens to the songs
You can cancel at any time, from your account screen, without asking us and without giving a reason. Cancelling stops the next payment; we do not refund the month you are in, and you keep making songs until it ends.
After you cancel, your songs stay readable and downloadable for 90 days. Your account screen shows you the exact date, in words, before you cancel — not afterwards — and offers you a download of everything at the same moment. After that date the songs are deleted and we cannot get them back.
You can download every song at any time, subscribed or not. We would rather you had your own copy than relied on ours.
6. The songs are your family’s
The songs your child makes are yours to keep, to play, to download and to share with your family and friends. This is meant to be a keepsake of childhood, and a keepsake you do not own is not one.
We do not publish anything your child makes, and we do not use your child’s words or songs to advertise Mini Songwriter. If we ever want to show a song to anyone outside your household, we will ask you first and you can say no.
We keep the right to run the service itself — storing the songs, showing them back to you, and making backups — and nothing more.
7. Using it fairly
A few things we ask you not to do:
- do not use the service to make anything that harms, frightens or sexualises a child;
- do not use somebody else’s card, or somebody else’s child’s name, without their say-so;
- do not try to break, overload or reverse-engineer the service, or resell it;
- do not use it to make songs about a real person who has not agreed to it.
If an account is used for any of those, we may suspend or close it. If we close your account for something you did, we will tell you why and give you a way to get your songs out first, unless the law stops us.
8. Your child’s information
What we collect, who else receives it, how long we keep it and how to delete it are set out in Our Privacy Notice, and it is the complete version. Nothing in these terms changes anything in it; if the two ever disagree, the Privacy Notice wins.
9. What we do not promise
We look after this carefully, and we still cannot promise the service will never be unavailable, never lose a song, or always produce a song you like. It is provided as it is, without warranties beyond the ones your local law gives you and that cannot be signed away.
Where the law allows us to limit what we owe you if something goes wrong, we limit it to what you have paid us in the twelve months before it happened. Nothing here limits anything that cannot lawfully be limited.
Download your songs. That is the honest advice behind this section: your own copy is the one nothing can take away.
10. Changes to these terms
If we change these terms in a way that materially affects you, we will notify you before the change applies — including through Mini Songwriter itself where that is appropriate — and you will have an opportunity to review it and, where applicable, to cancel before it takes effect. Small corrections — a clearer sentence, a fixed typo — we will simply make.
11. Law, and how to reach us
These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. Nothing in this section takes away a right you have under the consumer law where you live.
Write to hello@minisongwriter.com with anything at all — a question, a complaint, a request to delete everything. A person reads it.
